1. Acceptance of Terms
By installing, accessing, or using the Photopress application ("Service") on the Shopify platform, you agree to be bound by these Terms and Conditions. These terms apply to all Shopify merchants ("Vendors") and their authorized users who interact with our software.
If you do not agree to these terms, you must immediately uninstall the application and cease all use of the Service.
2. Description of Service
Photopress provides an enterprise-grade photobook editor and fulfillment workflow management system for Shopify stores. Key features include:
- A whitelabel photobook editor for customer use.
- Automated PDF generation and job management.
- Product and order synchronization with Shopify.
- Integration with selected printing and fulfillment vendors.
3. Account Eligibility and Responsibilities
To use the Service, you must have an active and authorized Shopify store. You are responsible for:
- Security: Maintaining the confidentiality of your account credentials and Shopify access tokens.
- Content Legality: Ensuring that all images, text, and designs uploaded by you or your customers comply with local laws and do not infringe on any intellectual property rights.
- Customer Support: Providing primary support to your customers regarding their photobook orders and design processes.
4. Intellectual Property
4.1 Ownership of Service
Photopress and its licensors own all rights, title, and interest in and to the Service, including the editor interface, code libraries, templates, and server-side processing systems.
4.2 User Content and Designs
You and your customers retain ownership of all original content (images and text) uploaded to the Service. By using the Service, you grant Photopress a limited, non-exclusive license to process and transmit this content solely for the purpose of providing the service (e.g., generating 3D previews and production PDFs).
5. Fees and Payment
All billing for the Service is handled securely through the Shopify Billing API. Fees may include:
- Monthly Subscription: A recurring flat fee for access to the platform and editor.
- Usage Fees: Potential per-order or per-page fees as specified in your selected plan.
- Taxes: All fees are exclusive of applicable sales, use, or value-added taxes, which will be charged based on your store's location.
6. Limitation of Liability
"To the maximum extent permitted by law, Photopress shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill, arising from your use of the Service or any technical failures during the PDF generation or order fulfillment process."
7. Termination
You may terminate these terms at any time by uninstalling the Service from your Shopify admin. Photopress reserves the right to suspend or terminate your access for violations of these terms, non-payment of Shopify fees, or any behavior that compromises the security of the platform.
Upon termination, all associated data will be deleted according to our Privacy Policy and Shopify's data redaction requirements.
8. Governing Law
These terms are governed by the laws of the jurisdiction in which Photopress operates. Any disputes arising from these terms shall be resolved in the courts of that jurisdiction.
